CNN —An attorney defending Texas’ controversial immigration law told a federal appeals court on Wednesday that state legislators may have gone “too far” when they passed the law last year. The law, known as SB4, makes entering Texas illegally a state crime and allows state judges to order immigrants to be deported. Nielson sought to downplay how sweeping the law was and argued it did not interfere with federal authority on immigration. An attorney for the Justice Department, which brought one of the lawsuits challenging the Texas statute, urged the appeals court not to depart from its previous ruling blocking the law. “Of course, we know that presidents come and go, and different administrations might very well enforce federal law differently,” he said, arguing that the law may not be necessary under a different presidential administration.

In an unusual order last month, Cannon asked attorneys on the classified documents case to submit briefs on potential jury instructions defining terms of the Espionage Act, under which Trump is charged over mishandling 32 classified records. Specifically, Cannon asked the special counsel and defense attorneys to write two versions of proposed jury instructions. Trump’s attorneys claim he did have that authority and have asked the judge to throw out the criminal charges. “Medical science has not yet devised an instrument which can record what was in one’s mind in the distant past,” Trump’s attorneys wrote. Cannon appeared skeptical that the charges should be outright dismissed during the hearing, but she said that Trump’s attorneys were making “forceful” arguments that may be appropriate to present to a trial jury.

☆ Texas federal court district rebuffs effort to curb ‘judge-shopping’ tactic

Judge-shopping is the practice of strategically filing cases in courthouses where the lawsuits are almost guaranteed to be heard by judges perceived to be sympathetic to the litigants. Texas has other US district courts with single-judge divisions, in addition to Amarillo, where challenges to the Biden administration agenda are frequently funneled through. The Judicial Conference announced after an early March meeting that it was seeking to curb the practice of judge-shopping with the new case assignment policy. The announcement prompted blowback from Republican senators, including Senate Minority Leader Mitch McConnell, who argued that any mandated policy would run afoul of a statute passed by Congress that gives each district court the discretion to design its case assignment protocols. When the Judicial Conference released the formal guidance days later, it indicated that the districtwide assignment policy was recommended, but optional.

The Comstock Act, as the law is known, is not central to the current Supreme Court case. Their interest in the law’s relevance to Tuesday’s case speaks to how the Comstock Act has taken a more prominent role in the efforts to further limit abortion. Among other arguments, the case’s plaintiffs, anti-abortion doctors and medical associations, have invoked the Comstock Act to argue the FDA acted unlawfully by not considering the 19th century criminal prohibition on mailing abortion drugs. But much attention will be paid to any commentary about the statute, even if just in a dissent, when the Supreme Court issues its ruling in the case in the coming months. CNN —A majority of Supreme Court justices appeared skeptical Tuesday of the idea of a nationwide ban or new limits on mifepristone, the primary drug used for medication abortions. At issue in the case are lower-court rulings that would have rolled back recent Food and Drug Administration decisions to ease access to the mifepristone. “What the court did … is enter sweeping nationwide relief that restricts access to mifepristone for every single woman in this country. Some anti-abortion activists see the law as an avenue to end medication abortion, and perhaps all kinds of abortions. CNN —The policy-making body of the federal judiciary is clamping down on the system that conservatives have successfully used in recent years to hamstring President Joe Biden’s agenda and other federal policies, including those concerning reproductive rights. The new policy seeks to curb “judge-shopping,” the strategy where litigants strategically file lawsuits in courthouses where the cases will be guaranteed to be heard by judges perceived to be sympathetic to their arguments. While the strategy has long been used in patent cases, there been a concerted uptick for politically charged, wide-reaching cases that have been filed in Texas by Republican state attorneys general or conservative, private-sector parties. But within El Salvador, a largely Catholic and evangelical Christian country, some viewed the women’s accounts with skepticism and hostility. Again, the UN’s human rights office weighed in, calling El Salvador’s laws “draconian.”Two months later, 11 justices from El Salvador’s Supreme Court commuted Vásquez’s sentence, saying evidence in the case did not prove that she had taken any action to end her baby’s life. CNN —Twitter turned over at least 32 direct messages from former President Donald Trump’s account – @realDonaldTrump – to special counsel Jack Smith earlier this year as part of the federal election subversion investigation, according to newly unsealed court filings. The unsealed filings shed new light on the extent of the special counsel investigation into Trump’s efforts to overturn his 2020 election loss. Much of that conduct played out publicly, including on Trump’s Twitter account, where he promoted bogus claims of mass fraud and urged government officials to disrupt certification of the results. At the time of the prosecutors’ court argument to the appeals court, Trump wasn’t charged in federal court in either case. Another court filing unsealed Friday said that the warrant sought information from October 2020 through January 2021.

McAfee’s order shuts down the effort by Fulton County District Attorney Fani Willis to have all 19 defendants tried together in October. Smith took more streamlined approach than Willis against Trump, and charged him by himself, without any co-defendants. Additionally, several of the Georgia case defendants have parallel proceedings in federal courts underway. If any of those requests are successful, it is still unclear what that would mean for the rest of Willis’ case. Meadows will continue to fight in federal court to move the proceedings out of state court.

CNN —Former President Donald Trump will be restricted on how and when he can look at, and talk about, classified information, a judge decided Wednesday after a sealed hearing the day before. The development is one of the first times the court has set terms around classified information in a case where Trump’s team has tried to downplay the seriousness of how records were handled. Cannon held a sealed hearing about the handling of classified information in the case on Tuesday in South Florida, according to multiple sources familiar with the proceeding. But the judge said the SCIF areas would be overseen by a third-party officer from the federal government designated to guide the handling of the classified information in the federal case. Cannon’s order on Wednesday also specifies that apparently classified information in the case that hasn’t clearly been identified as being declassified should be treated with sensitivity.

CNN —Former President Donald Trump is asking Judge Tanya Chutkan to recuse herself from the 2020 election subversion case against him brought by special counsel Jack Smith. Trump, in a new court filing Monday, pointed to comments that Chutkan made in cases involving January 6 US Capitol rioters. “Presidents are not kings, and Plaintiff is not President,” Chutkan wrote in that ruling. Trump’s request that she not oversee the criminal case against him is likely an uphill battle, as it was filed with Chutkan herself. Trump also previously sought the removal of the judge overseeing the New York criminal case against him related to hush money payments.
